CITY COUNCIL MEETING 

May 27, 2008

7:00 p.m.

The Governing Body of the City of Edwardsville, Kansas met in regular session on Tuesday, May 27, 2008, at 7:00 p.m. in the City Hall Council Chambers. 

The following Councilmember’s were present with Mayor Heinz Rodgers presiding:

            Chuck Adams                          Craig Crider                             Doug Danner
            John Eickhoff                         Patrick Isenhour 

The following staff members were present:
            Michael Webb, City Administrator
            Reed Walker, City Attorney
            Phyllis Freeman, City Clerk
            Mark Mathies, Police Chief

Councilmember Danner expressed the Council’s condolences in the passing of Mayor Rodgers mother.

MINUTES OF MAY 12, 2008 

Councilmember Crider moved to approve the minutes of May 12, 2008. Councilmember Eickhoff seconded. 

Mayor Rodgers requested a roll call vote.

The motion was declared carried. 

PAYMENT OF BILLS - $206,459.79

Councilmember Eickhoff moved to approve payment of bills totaling $206,459.79. Councilmember Isenhour seconded. 

Mayor Rodgers requested a roll call vote.

REQUESTS OR COMMENTS FROM THE PUBLIC 

Richard Carter, 629 S. 4th Street gave his condolences to Mayor Rodgers and asked for an update regarding the tower project.

Councilmember Crider stated information should be coming in by the middle or end of next month with a favorable presentation.

Rebecca Carter, 629 S. 4th Street asked if Mayor Rodgers had made the appointment yet.

Mayor Rodgers stated no.

CONSIDER RESOLUTION NO. 2008-07

AUTHORIZING AGREEMENT OF WITHDRAWAL FROM MARCIT

AND FORMATION OF A KANSAS GROUP FUNDED POOL

AND RESOLUTION NO. 2008-08 AUTHORIZING

PROCUREMENT OF PROGRAMS OR SERVICES WITH MARCIT-KANSAS 

After discussion it was recommended by Administrator Webb to table action on both resolutions until a June meeting.

Councilmember Adams moved to table Resolutions 2008-07 and 2008-08. Councilmember Danner seconded. 

Mayor Rodgers requested a roll call vote.

CONSIDER RESOLUTION NO. 2008-09

ADOPTING THE EDWARDSVILLE PERSONNEL MANUAL

EFFECTIVE JULY 1, 2008

Councilmember Isenhour moved to table action for Resolution 2008-09. Councilmember Adams seconded.

ADVISORY REPORTS 

CITY ADMINISTRATOR MICHAEL WEBB 

Administrator Webb requested an executive session for 15 minutes for discussion regarding acquisition of real property.

Administrator Webb reported:

It is time for the 2009 budget review. A draft budget will be presented to the Council at a June meeting and adoption of the 2009 budget at the August 11, 2008 council meeting.

It was recommended to adopt a “Transient Guest Tax”. Most cities have  established a rate of 6%. The tax is utilized for economic development and tourism. It would be necessary to adopt a Charter Ordinance in order to establish a 6% rate. The current rate by state statute is 2%. By adopting a Charter Ordinance it would be effective October 2008.

Discussion of becoming a City of the 2nd Class. DeSoto has made the change. The city must first request the Governor to proclaim compliance with the Statute. The request must be in the form of a resolution.

Good news insurance rates are going down with Thomas McGee. The public official’s rate is down 22%. No increase in law enforcement. It was recommended to have a Crime policy for the bonded employees, possibly a blanket policy that would cover all employees that handle funds of the city.

Utility billing for sewer and trash service has a 30% collection rate as of today. Meeting with Board of Public Utilities Wednesday and the Unified Government next week.

Woodend Road Improvements: some materials have been stored on site.

POLICE CHIEF MARK MATHIES 

Police Chief Mathies prepared the following reports; incidents by offense; ticket totals; overtime report; accident summary; court activities/dispositions;  municipal court fines and payments; theft/burglaries January through May. Some items have been recovered that were stolen from Holiday Sand and the City of Bonner Springs. Detective Guy Redinger has done a great job. The department should be back to full staff by July 18th.

Administrator Webb stated Chief Mathies and Detective Redinger have put in some long days and we appreciate their efforts. Members of the police force participated in the Torch Run for Special Olympics.

Chief Mathies stated this is the first time that Edwardsville is a part of the Torch Run for Special Olympics.

CITY ATTORNEY

CITY ENGINEER 

No report at this time.

COUNCIL AND MAYOR COMMENTS 

Councilmember Isenhour apologized for not attending the last council meeting due to a tooth extraction.

Councilmember Isenhour reinforced the fact that the Mayor can vote on a split vote.

Councilmember Isenhour requested an additional 5 minutes during the executive session for attorney/client privilege.

Councilmember Isenhour stated his grandmother has two water meters with two trash bills but only has one residence. He requested an adjustment.

Administrator Webb stated he will get with City Treasurer regarding the correction.

Councilmember Crider stated he along with councilmen Adams and Danner attended the Memorial Day ceremony at the Edwardsville Cemetery. It was excellent, Jim Eickhoff played taps on a bugle dated 1918 that was used by a World War I veteran.

Councilmember Adams reported there will be a Kids Day at the Edwardsville Christian Church on Saturday, June 7th starting at 9:00 a.m. There will be various forms of entertainment and activities for the kids; farmers market; checking child restraint seats will be available.

Mayor Rodgers stated he is cancelling the Town Hall meeting scheduled for Thursday, May 29th.

Mayor Rodgers commended the work being done by the Police Department.

 EXECUTIVE SESSION

Councilmember Isenhour moved to go into an executive session for no less than 15 minutes starting at 8:15 p.m. for discussion of acquisition of real property and attorney/client privilege. Councilmember Eickhoff seconded.

RECONVENE TO REGULAR SESSION

Mayor Rodgers reconvened regular session at 8:40 p.m.

ADJOURNMENT

Councilmember Eickhoff moved to adjourn at 8:41 p.m. Councilmember Isenhour seconded.

Mayor Rodgers declared the motion carried.
