CITY COUNCIL MEETING

September 27, 2010
7:00 p.m.

The following councilmember’s were present with Mayor John McTaggart presiding:

Chuck Adams        Mark Bishop        Craig Crider        Doug Danner
   
Councilmember John Eickhoff was absent.

The following staff members were present:
Michael Webb, City Administrator
David Duckers, City Attorney
Tammie Burgoon, Secretary
Mark Mathies, Police/ Fire Chief


APPROVE MINUTES OF SEPTEMBER 13, 2010

Councilmember Adams moved to approve the minutes. Councilmember Danner seconded.

Mayor McTaggart requested a roll call vote. Councilmember Crider abstained.
The motion passed unanimously. 

STATEMENT OF BILLS - $104,171.83

Councilmember Adams moved to approve the statement of bills. Councilmember Crider seconded.

Mayor McTaggart requested a roll call vote. The motion passed unanimously.

 
REQUESTS OR COMMENTS FROM THE PUBLIC

Richard Herdman, 215 N. 110th Street stated he had received a letter regarding the benefit district and that he was not able to participate due to the current taxes he pays on his property. The additional cost based on what was presented to him to be a part of the benefit district places a hardship on him and he would be gone. To him that seems like a slow way of eminent domain to snag someone’s property from them through taxing them completely out of their property. If he
could be excluded from the benefit district, and it would come through, and he gets a payment for his property he will write a check for the full amount. He doesn’t have a problem paying for his portion but right now it is financially impossible. Other land owners have more financial flexibility. When Golden Gaming and Cormack were going to develop they were going to pay for the sewers. Just because you build it doesn’t mean they are going to come. If you had someone come in and they agreed to build it, buy everybody’s property, and you put the sewers in at the landowner’s expense as soon as his check clears he would write the city a check. It would be good for the city if something would be going in up there but he does not feel he should be pushed out of his property for the betterment of Edwardsville.

Administrator Webb stated it would be no problem to be excluded from the benefit district.

CONSIDER RESOLUTION 2010-07
TO ISSUE INDUSTRIAL REVENUE BONDS
NOT TO EXCEED $10,000,000
TO FINANCE A NEW COMMERCIAL FACILITY
FOR THE BENEFIT OF ISCO, LLC
(Earp Distribution, 2730 S. 98th Street)

Councilmember Adams moved to adopt Resolution 2010-07 to issue Industrial Revenue Bonds not to exceed $10,000,000 to finance a new commercial facility for the benefit of ISCO, LLC (Earp Distribution, 2730 S. 98th Street).  Councilmember Bishop seconded.

Mayor McTaggart requested a roll call vote. The motion passed unanimously.


CONSIDER REQUEST FROM BONNER SPRINGS-EDWARDSVILLE
CHAMBER OF COMMERCE TO PROVIDE A
FREE OPEN AIR MUSIC CONCERT ON OCTOBER 9, 2010
FROM 8:00 – 11:00 p.m.
DUE TO RAIN DURING AUTUMNFEST FESTIVAL

Councilmember Danner moved to accept the request from Bonner Springs-Edwardsville Chamber of Commerce to provide a free open air music concert on October 9, 2010 from 8:00 – 11:00 p.m. due to rain during Autumnfest Festival. Councilmember Bishop seconded.

Mayor McTaggart requested a roll call vote. The motion passed unanimously.

ADVISORY REPORTS
ADMINISTRATOR’S REPORT

City Administrator Webb stated that 110th street project started earlier than expected.  The project is moving along and should be completed no later than November 15, 2010.

Councilmember Adams suggested possible signage located on K32 would be helpful.

City Administrator Webb also stated that some repairs are being made on Edwardsville Drive, along with milling and paving on 4th street.

CHIEF OF POLICE & FIRE

Chief Mathies stated that Captain Paul Clark and Master Sergeant Terry Hammontree did a great job in his absence.  He also stated that we have a new employee, Grady Ratliff that is with David Adell at the Fire Fighter I and II Academy for the next 14 days.  They are both paramedics.

CITY ATTORNEY

Attorney David Duckers stated that the Davidson case is still moving a long.  We are still waiting on a decision.

CITY ENGINEER

No report at this time.
COUNCIL & MAYOR COMMENTS


Councilmember Adams stated that we strive every year to make Autumnfest a neighborhood event and this year we definitely achieved that.

We have an opportunity to bid on a tractor for the city.  This will be used to help with the brush along the roadways.  The tractor will come with attachment and is worth around $60,000.00 brand new.

Councilmember Adams moved that the city could bid up to $18,000.00 for the tractor.  Councilmember Danner seconded.

After discussion Councilmember Adams amended his motion to allow for the city to bid up to $25,000.00 for the tractor. Councilmember Danner seconded.

Mayor McTaggart requested a roll call vote. The motion passed unanimously.

Councilmember Adams also congratulated Councilmember Bishop on his success with the BBQ competition. 

Councilmember Bishop added that we had a 75% increase from last season with our first sanctions competition.

Councilmember Bishop thanked the Police and Fire Department for a performing a wonderful job during the Autumnfest events. 

Councilmember Crider stated that the bank area between Williamson’s Farms and the Episcopal Church is washing away. 

City Administrator Webb stated that with the road work he has the belief that situation should be corrected during road improvements.

Councilmember Crider also addressed concerns regarding weed spraying around signs in the city. Bonner Springs mows around their signs. He requested not spraying around the signs in the future.

Mayor McTaggart thanked Councilmember Bishop on a wonderful job with the BBQ competition and that the Police and Fire Departments did and excellent job during Autumnfest. 

Mayor McTaggart added that the ribbon cutting for Dollar General would be October 2nd at 7:55am.  Dollar General will be giving out $10.00 gift cards to the first 50 customers.

ADJOURNMENT

Councilmember Bishop moved to adjourn at 7:40 p.m. Councilmember Crider seconded. Mayor McTaggart declared the motion carried.
