PUBLIC HEARING
Amending Section 30.18; Zoning Ordinance 639 to Regulate the Placement, Erection, Materials, Type, Height, Composition, of Fences on Private Property
Chairman Martinique: We will call the Public Hearing amending section 30.18; zoning ordinance 639 to regulate the placement, erection, materials, type, height, composition, of fences on private property. This was posted accordingly with a public notice. Dan, do we have a staff report?
Dan Van Petten: Yes we do. (Please refer to Item A attached).
Chairman Martinique: Do we have any comments from the public?
Doug Danner: 452 Blake, Edwardsville, KS, I just came here tonight, commission, just to ask a question. Looking over the preliminary that was in our packet last time, there was nothing said about commercial fencing. I wondered if that is covered someplace else or you don’t anticipate anyone putting a fence around a dumpster or something?
Dan Van Petten: Landscaping and screening, that handles the trash enclosures around a commercial building. We do address commercial in that you can’t have security or barbed wire. It is not used in commercial or intensive or C2 commercial extensive districts. So we do specify what you can’t use, otherwise you can use fencing.
Doug Danner: Okay, that is all I had. Thank you.
After a detailed discussion of the proposed fence ordinance:
Chairman Martinique: If there are no other comments, we will close the public hearing.
REGULAR MEETING
Chairman Martinique: We will call the regular meeting of the planning commission to order. Does anyone have anything to discuss before we entertain a motion?
After a brief discussion regarding ordinance details:
Michael Webb: I think it would be a good idea to review the requested changes as discussed in the public hearing. (Please refer to Item A attached.)
Bryan Smith: I make a motion to amend the fence ordinance as distributed with the incorporation of the changes just discussed.
Kelli Curry: Seconded. Motion carried
ITEMS FROM THE PLANNING COMMISSION
Chairman Martinek: Mike, is there anything from a planning commission point of view that we have to do on this violation of zoning? Please refer to Item B attached.
Michael Webb: They are clearly a non-conforming use. We do have a temporary permit process in place. The first thing I would suggest is that we contact each of these individuals and advise them that they are in violation of the zoning ordinance and request a temporary use permit.
After further discussion, it was determined the planning commission does not need to take any additional steps at this time, the city staff will proceed as suggested.
